Reimbursement of compensation for untaken vacation from the Austrian vacation BUAK fund

Employees working in Austria in the construction sector are entitled to reimbursement of untaken vacation under certain conditions. How does the Austrian BUAK fund work?

What is the Austrian BUAK fund?


The Austrian BUAK fund manages and administers the vacation entitlement of employees working in the construction sector. In addition, it also manages the entitlement to severance pay, winter vacation and the bridging allowance, which is linked to the restrictions on work during the winter months.

Entitlement to vacation


Employees are entitled to vacation from their current employer. This is different in the construction sector because of the frequent changes in employment in construction companies. The BUAK fund manages the employees vacation on the principle of transferring vacation between employers. Vacation accrued by an employee with one employer can be taken by the employee (upon termination of employment) with the new employer. If the employee does not take up employment with the next employer, they may request reimbursement of unused vacation pay.

Reimbursement of compensation for untaken vacation


An employee is entitled to be reimbursed for untaken vacation from the BUAK fund after termination of employment if:

  • worked in Austria in the construction sector for an Austrian company,
  • he worked in Austria in the construction sector as a seconded employee of a Czech company and his employer made contributions to the BUAK fund on his behalf.

The employee can only apply for reimbursement of unused vacation pay six months after the end of employment if they have not been re-employed during that period (in an Austrian construction company or as a seconded employee of a Czech construction company in Austria).

If the employee has been employed by a new employer within six months after the termination and has not taken vacation with the original employer, the employee has two options:

  • he can take the vacation from his previous employment with the new employer,
  • he can request reimbursement, but only after the end of the current employment relationship and after the subsequent expiry of the six months.

Unused vacation pay can only be reimbursed on the basis of a request.



How do I know how many days of vacation I am entitled to?


The BUAK fund sends a statement to employees every quarter. It shows the number of days of vacation the employee has taken and the number of days to which the employee is still entitled. The last statement also indicates the date by which vacation can be claimed. It is therefore important to keep an eye on the entitlement to untaken vacation to prevent its forfeiture.
