Everybody who works abroad has to pay income tax. Under certain conditions, you can refund some of the taxes you (your employer) paid. We refund tax from Austria and we can also help you get child benefits or pension contribution refund.
Taxation is progressive on the individual's income in Austria. In other words, the more you earn, the more you pay. Under the Austrian Income Tax Act each individual is taxable on his/her own income and there is no joint taxation for married couples or households. Austrian tax rates for individuals are between 25% and 55% from 2016 to 2019. From 2020 between 20% and 55%.
In order to get your income tax refund as quickly as possible and to apply for the highest amount, you need to have: - A copy of your Lohnzettel form from each of your employers; - A L1i form if you worked less than 6 months in Austria - A certified E9 - EU/EWR Bescheinigung form which proves your local income from your home country
Lohnzettel is a summary of earnings and deducted taxes by an employer during a calendar year. All employers are legally obliged to issue the form by the end of February of the following year (for example, by the end of February 2022 for fiscal year 2021).
According to the Austrian tax office, you can go back as far as 5 years from the year in which you apply.
Even if you do not have all documents, you can still apply for your tax refund. We offer a “replacement” service - we will contact your former employers and will claim copies of your payment documents as your certified tax agent.
Our service is designed for those who miss some important document which is necessary to complete a tax obligation in given country. Usually this document is the final earning document from your employer for given year.
We will do our best to replace any document needed in the process of doing with your taxes. In most cases, we focus on the final earning documents from your employer but we can help you also with requesting a copy of your tax return for instance.
We contact the relevant authority or employer and try to find a way for the document to be reissued. We cannot guarantee that a given document will be provided but we will do our best to obtain it for you.
The length of this process depends on how willing the other party is to cooperate. The process usually takes 2 weeks but can be prolonged to several months if the counter party is not cooperative.
Child benefit is money granted to parents for their children, regardless whether the parent is in employment or the income level.
2016-2017 (monthly) - from birth up to 3 years 111,8 EUR - over 3 years 119,6 EUR - over 10 years 138,8 EUR - over 19 years 162 EUR 2018 monthly - from birth up to 3 years - over 3 years 121,9 EUR - over 10 years 141,5 EUR - over 19 years 165, 1 EUR
Yes, you can be receiving the child benefits in your home country and also apply for them abroad. The benefits from foreign country will be calculated in such a way that the final sum of the benefits from both countries will be equal to the maximum amount in foreign country.
All citizens of European Union, Switzerland, Serbia, Montenegro, Bosnia and Herzegovina, Algeria, Kosovo, Morocco, Tunisia and Turkey. Parents are entitled to family allowance if their centre of life is in Austria and their child (which can also be an adopted child, a foster child, a stepchild) lives together with them in the same household.
Basically, there might be these situations: if you are married, any of you - parents can apply for this benefit if you are not married or divorced, only the mother can apply if you are divorced AND the child is living with the father (father is the only legal guardian), only the father can apply
In case your family is living in another country (while you live and work abroad), you will need to get E401 form. This confirms the family condition (e.g. you are not divorced and the child is not living only with the mother) and the address where the child is living. This document is filled out and stamped by the city hall.
Non-EU citizens can claim back their Austrian pension contributions (about 9.5% of salary) 2 years after leaving Austrian /EU if they paid into the pension funds for a period under 5 years. Only months in which a contribution was made count towards this period and only the employee contributions are refunded, not the one from employers. You should also be aware that working in other EU countries can count towards the 5 year period. EU citizens can claim their pension benefits from Austria after they reached the pension age.
A refund means that you paid your pension contributions, and you can get it back with the conditions above. By filing a claim, you are actually reporting to the insurance company that you left Austria/EU and there is no need for them to keep your pension contributions.
There is no such thing as a “more refund” on your pension. Be careful, because this might be a marketing trick to attract you to sign a contract. If a tax specialist files your pension refund claim properly, according to the German pension law, the refund can be calculated in only one possible way!
In order to get your pension refund as quickly as possible and apply for the highest amount, you need to have: Lohnzettel from all employment for each tax year Registration and deregistration certificate from Austria (you can prove it with the stamps in your passport or with the document An- and Abmeldebescheinigung from Austrian authorities) Passport
Even if you do not have all the documents mentioned above, you can still apply for your pension refund. We offer a “replacement” service - we will contact your former employer/s and will request copies of your earning documents (wage slip) as your agent.
L1i – Erklärung zur ArbeitnehmerInnenveranlagung is also known as an employee’s declaration of tax measurement. This will be needed when you worked less than 6 months (183 days) in Austria in order to apply for unlimited tax liability. You can find more information about unlimited tax liability here. It provides an additional confirmation to the Austrian tax authorities about your foreign earned income and residency status during the given tax year. Each L1i form has a unique number which is registered at the Austrian tax office. Based on this form you will be considered an Austrian tax resident and will be able to benefit from the Austrian tax benefits.
L1k form can be used to claim child allowances, alimony payments, or other extraordinary expenses related to children as part of the employee tax assessment. For example if you have low income and are entitled to the single-earner or single-parent tax credit, you need to use this form. These amounts can be paid out: Number of Children Single earner / single parent tax credit 1 child 494 € 2nd child: 175 € 2 children € 669 3rd child: € 220 * 3 children € 889The condition for this bonus is to receive Familienbeihilfe minimum of 7 months during the given tax year.
The L1k-bF form or Familienbonus Plus is only available from 2019 to people who are fully taxable in Austria and who receive family assistance (Familienbeihilfe) for their child(ren). The Family Bonus Plus for children who have not yet reached the age of 18 is 125 euros per month (1,500 euros per year). For children who have already reached the age of 18 but are still receiving a family allowance, the Family Bonus Plus is EUR 41.68 per month (EUR 500 per year). The condition for this bonus is to receive Familienbeihilfe minimum of 7 months during the given tax year.
The process of receiving the forms is a bit more complicated. These are not publicly accessible documents, therefore it is not possible to download them and fill them. You have to request them online from the Austrian tax office and then they will be sent to you via post in a few weeks. Does that sound complicated to you? We make it more simple! You can start right now here in our app. After completing the tax return in our app you should select: Form L1 * For a fee of 5 €, we will send it to you via post in a few days
